1. Purpose
These Terms govern access to and use of the website silvamenendezlegal.com, owned by Jessica Silva Menéndez.
Using the website implies the user’s acceptance of these terms.
2. Proper use of the website
Users undertake to use the website lawfully and respectfully, refraining from any action that may:
- infringe the rights of third parties;
- affect the operation or security of the website;
- introduce malicious software or harmful code;
- attempt to gain unauthorized access to systems or information;
- use the content for unlawful or fraudulent purposes.
3. Informative content
The content of the website is general and informative and does not constitute personalized legal advice.
The information published should not be used as a substitute for professional advice on a specific case.
Particularly in immigration, international mobility and corporate law, requirements and procedures may vary depending on the individual situation, nationality, documents available, competent authorities and current legislation.
4. Requesting and booking consultations
The website may allow users to request or book a consultation through the tools provided for that purpose.
Booking a consultation does not necessarily mean that a professional engagement to handle a matter afterwards has been accepted.
The scope of any additional legal service, fees, terms and responsibilities will be agreed separately where applicable.
The website currently does not allow online payments.
Payment for the consultation is made before it takes place, by bank transfer, Bizum, Stripe or PayPal, using the payment link or details sent to the client by email or WhatsApp after booking. The consultation is confirmed once the payment is received.
5. Cancellations and rescheduling
- Up to 24 hours before the booked time, the client may cancel or reschedule free of charge. If the client has already paid and cancels, the full amount is refunded.
- If the client cancels less than 24 hours in advance or does not attend, the amount is not refunded. For a justified reason, the firm may offer a single change of date.
- If the firm cancels the consultation, the client may choose between a new date or a full refund.
- If the client is late, the consultation ends at the scheduled time.
Clients who are consumers have a 14-calendar-day right of withdrawal from the booking. When booking, they may expressly request that the consultation take place within that period; in that case, if they withdraw after the consultation has begun, they will pay the proportional part of the service provided, and they will lose the right of withdrawal once the consultation has been fully provided (articles 103(a) and 108.3 of the Spanish Consolidated Consumer Protection Act).
6. Lawyer-client relationship
Simply accessing the website, or sending information, a form, an email or a consultation booking, does not automatically create a lawyer-client relationship.
Whether a professional relationship exists, and its scope, will be determined by the express acceptance of the corresponding engagement.
Until then, users should not assume that representation or handling of their matter has been accepted.
7. Accuracy and updating of content
Every effort is made to keep the information published clear and up to date.
However, legislative, case-law, administrative or procedural changes may occur without it being possible to update all the content of the website immediately.
The information should therefore be confirmed in light of the specific circumstances of each matter.
8. Availability of the website
Permanent and uninterrupted availability of the website is not guaranteed.
Interruptions may occur due to maintenance, updates, technical incidents, actions of third parties or other circumstances.
9. Intellectual property
The original content of the website belongs to Jessica Silva Menéndez or is used with the corresponding authorizations or licenses.
Its exploitation, reproduction or commercial use without prior authorization is not permitted, except where allowed by law.
10. Changes
These Terms of Use may be updated when necessary due to changes in the services, the operation of the website or the applicable legislation.
