Children of residents and other situations

Residence for minors

Permits for foreign minors, such as children of residents born in Spain, and other situations provided for in the legislation.

Is this the right option for you?

The most common case is that of children born in Spain to foreign parents with legal residence. We also handle other situations, such as reunifying children who live outside Spain.

We review the parents’ situation, the deadlines and the child’s documents to choose the right route and not miss any deadline.

If the six-month deadline has passed, the route is usually family reunification.

Main requirements

These are the essential requirements. The specific documents may vary depending on your nationality, your personal situation and changes in the law.

  1. Born in Spain

The child was born in Spain, is registered in the Civil Registry and is in Spain when the application is filed.

  2. Parent with residence

At least one parent holds a residence permit.

  3. Six-month deadline

Applying within six months of the birth or, if the child has not left Spain, within six months of the parent obtaining residence.

  4. Child’s situation

The child is not a national of an EU country, the EEA or Switzerland.

  5. Fee

    Paying the corresponding fee.

Duration

The permit is granted for five years and its renewals follow the long-term residence procedure.

Who applies

One of the parents holding a residence permit, at the Immigration Office or online, directly or through an authorized professional. Once the child reaches working age, it allows them to work without further steps.
